Jay Sekulow: Newly-obtained documents reveal Obama team’s last-minute anti-Trump tactics

From even before President Donald Trump was sworn into office, it was suspected by some that the outgoing Obama administration had undertaken efforts to sabotage and undermine the incoming presidential team.

Evidence was recently uncovered that essentially confirms those suspicions. New documents reveal top Obama officials made moves in the final days of that administration to empower the federal bureaucracy — colloquially referred to as the “Deep State” — in opposition to Trump, his administration, and his agenda.

Last-minute maneuvers

That bombshell confirmation came by way of an op-ed written for Fox News by Jay Sekulow, chief counsel of the American Center for Law and Justice (ACLJ) and a member of President Trump’s legal team, who received the documents via a Freedom of Information Act (FOIA) lawsuit filed against Office of the Director of National Intelligence and the National Security Agency.

The documents show that then-Director of National Intelligence James Clapper and others scrambled in the final days of the Obama administration to finalize new rules and procedures that significantly expanded bureaucratic access to raw signals intelligence and classified information prior to the application of previously standard identity and privacy protections.

In essence, the new rules and procedures made it easier for federal bureaucrats who deemed themselves part of the “resistance” to Trump to gain access to raw intelligence that could be leaked or otherwise used to undermine the incoming administration.

Enabling leakers

Sekulow noted that this effort led by Clapper and involving then-Attorney General Loretta Lynch was only finalized in the waning days of the Obama administration, just weeks prior to Trump assuming office on January 20, 2017.

“By greatly expanding access to classified information by unelected, unaccountable bureaucrats, the Obama administration paved the way for a shadow government to leak classified information — endangering our national security and severely jeopardizing the integrity and reputation of our critical national security apparatus — in an attempt to undermine President Trump,” Sekulow wrote.

The attorney further argued that no future president or president-elect should ever be subjected to similar targeting. Furthermore, those who were responsible for these actions should be held fully accountable to the rule of law and face justice for what was done.

Nefarious intent

The document that appears to be at the center of the effort to undermine Trump was executed on Dec. 15, 2016, by DNI Clapper, and was titled “Procedures for the Availability or Dissemination of Raw Signals Intelligence Information by the National Security Agency Under Section 2.3 of Executive Order 12333.”

Other documents in the days and weeks following that show bureaucrats in multiple agencies and departments working quickly to finalize the new procedures laid out in that order from Clapper, with a specific intent evident to have it all finalized before President Trump took office.

Attorney General Lynch similarly executed and thus finalized the document on Jan. 3, 2017, less than three weeks before Trump’s inauguration.

“We have been working to unearth the facts of this Obama administration anti-Trump effort through our Freedom of Information Act lawsuits for more than two years,” Sekulow concluded. “We will continue to pursue new information about this strategy to embolden the Deep State.”
