On Friday, a Los Angeles federal judge blocked a new Trump administration policy that was intended to keep migrant families together while upholding the integrity of the immigration process.
The policy would allow migrant children to be detained together with their families in licensed facilities for longer than 20 days, which is not generally enough time to get an asylum hearing, Fox News reported.
U.S. District Court Judge Dolly Gee said the Trump administration couldn’t constitutionally end the Flores Agreement, which set the 20-day rule in 1997. Gee was concerned that the new rules would lead to indefinite detention times in unlicensed facilities that some have likened to prison camps.
She argued that the administration’s proposed rules “fail to implement and are inconsistent with the relevant and substantive terms of the Flores Settlement Agreement.”
Using Children
Lawyers arguing against the new Trump rules said that the administration was “using children” to discourage immigrants from seeking asylum, but in reality thousands of immigrants have tried to use children to get across the border.
This year, over six thousand migrants have been caught attempting to cross the border as part of fraudulent family units, Acting Secretary of Homeland Security Kevin McAleenan said.
Ending Family Separations
In actuality, the Trump administration is trying to end the practice of separating parents from their children by making it so that both can be detained together. Ending the 20-day rule would allow families to stay together because it takes much longer than 20 days for asylum hearings to happen.
“We want to keep families together through an immigration proceeding that’s fair and expeditious in an appropriate setting,” McAleenan said in July. “That can’t be done in 20 days with due process.”
Let’s be real: immigrant advocates have long “used” children to allow immigrants to enter the country, to “anchor” whole families of immigrants that would have been illegal, and to play on the sympathies of the American people.
Immigrants released
The left opposes this new Trump rule because they know that the old rules result in most immigrants being released into the United States, never to be heard from again. Once they are in the U.S., they make lives for themselves and usually decide not to return for their immigration hearings, which might result in their deportation.
The status quo might result in some family separations, but it results in many more releases. And those who want to see open borders are okay with that.
They don’t want a real solution to the problem. They don’t really care about the children as much as their global agenda. Trump can’t let them win.
