When President Trump nominated Brett Kavanaugh for the Supreme Court, conservatives hoped that a long-awaited rightward shift would occur in the Supreme Court.
It looks like that moment has arrived. The Law and Crime blog reports:
Supreme Court Justice Brett Kavanaugh broadcast a signal that could spell the end of the administrative state as we know it.
In a nutshell, Kavanaugh established in a concurring opinion, that he’s ready to join the four other conservative justices on the bench in taking away the unconstitutional powers of unelected bureaucrats in the administrative state to legislate.
Legislation is the job of Congress, not agencies staffed with career bureaucrats who were never elected. A just government is by the consent of the people. If an official is not elected, they lack the constitutional authority to make law.
Of course, liberals love the power of unelected regulators, particularly when it comes to the environment. That’s why liberal legal commentators are running scared:
“Welp, there it is: Kavanaugh signals his agreement with Gorsuch’s Gundy dissent,” noted legal analyst Mark Joseph Stern. “There are now five votes for a nondelegation revolution. Get ready for the Supreme Court to tear down the administrative state.”
It’s happening, and President Trump should take a well-earned victory lap. His two nominees, Gorsuch and Kavanaugh, are making a difference.
